Confidential Information: Any
information, features, procedures, Content, or any organization or
formatting thereof, that is not widely known or widely obtainable by
non-users of Treatment First, any trade secret, and/or any proprietary
information obtained from TreatmentFirst and/or through
treatmentfirst.com.
2. Use of treatmentfirst.com
This website (“treatmentfirst.com”) is provided solely for the use
of current TreatmentFirst customers to interact with TreatmentFirst
and may not be used by any other person or entity, or for any other
purpose. For example, all medical provider location searches,
reporting features, user input data, and other information and
services may only be used by current TreatmentFirst customers for
their own use. Use of treatmentfirst.com to provide
information to, locate medical providers for, or provide marketing
reports or information of any kind by or for the benefit of
non-subscribing entities is strictly prohibited.
The use of scripts, data-mining
programs, automated dial-in, inquiry devices, or any automated devices
or methods to obtain information through treatmentfirst.com is strictly prohibited. You may not obtain data from TreatmentFirst and
re-sell that data or pass off that data as coming from a different
source.
TreatmentFirst does not accept ideas,
concepts, or techniques for new services or products through treatmentfirst.com. If such information is received, it
will not be considered confidential and TreatmentFirst will be deemed
free to use, communicate and exploit such information in any manner it

provide accurate and current information about yourself as prompted by
the treatmentfirst.com Login Registration pages and
maintain and promptly update your online profile information to keep
it accurate and current.

translate, transmit, distribute, adapt, reproduce, decompile, reverse
engineer, or disassemble any part of treatmentfirst.com or its Content, and You agree that you
will not assist any other entity to do so.
In
the event that You invent any additions to, refinements of, or
improvements related to intellectual property in the field of this
website or as a result of having used this website, You agree to
assign and hereby assign all intellectual property related thereto to
Treatment First, Inc.
Nothing in this Agreement shall be
deemed, by implication or otherwise, to convey to You any rights under
any patents, patent applications, copyrights, trademarks, trade

commitment of any kind by either You or TreatmentFirst to enter into
any further agreement with each other.
Should the parties enter into any such further agreement, this
Agreement shall not terminate but shall continue in full force and
effect according to the terms and conditions hereof. You further agree not to take any action
challenging or opposing, on any grounds whatsoever, Treatment
First’s Intellectual Property rights, or the validity or
enforceability thereof.
5. Disclaimer of
Warranty

AND ITS CONTENT ARE PROVIDED "AS IS." TREATMENTFIRST AND ITS
LICENSORS DISCLAIM ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED,
INCLUDING WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND
NON-INFRINGEMENT, REGARDING ANY SUCH CONTENT AND YOUR ABILITY OR

Agreement, or a portion thereof, to be unenforceable, that provision
shall be enforced to the maximum extent permissible. Moreover, if one or more provisions of this
Agreement, or any portions thereof, are held to be invalid or
unenforceable, the remaining provisions shall remain in force and have
full effect. You agree that any action at
law or in equity arising out of or relating to these terms shall be
filed only in the state or federal courts located in Orange County,
California, and you hereby consent and submit to the personal
jurisdiction of such courts for the purposes of litigating any such
action.

Information

Confidential Information. You agree that Confidential Information obtained
from or through TreatmentFirst shall be used only by You and that You
shall not take any actions that would jeopardize its status as

Your reports private or confidential. By using TreatmentFirst

providing the technical functionality only, and that You are solely

for the data input that generates these reports, and you accept full

manner that would eliminate or jeopardize the existence, validity,
enforceability, or ownership of Confidential Information and/or
Intellectual Property belonging to
